Although the professionals carrying out probate services are usually solicitors, the provision of `estate administration` is essentially without regulation. There are several benefits to using solicitors firms rather than `Probate Companies` or `Trust Corporations`. Benefits include that solicitors firms must be:
- Fully qualified
- Regulated by the Solicitors Regulation Authority or the Council for Licensed Conveyancers
- Insured with Professional Indemnity Insurance
Not all Probate Companies use qualified solicitors. This means they do not have a requirement for regulation or insurance if something goes wrong. These companies are often known as Trust Corporations. You can recognize them if they ask you to sign a Power of Attorney. If you decide to use one, then first check they are regulated and insured.
